License Agreement
The term "mathStatica" refers to a computer program package. It does not include the book "Mathematical Statistics with Mathematica". The terms "we", "our" and "us" refer to MATHSTATICA Pty. Ltd. (ACN 097 821 737), of Sydney, New South Wales, AUSTRALIA, its successors and/or assigns. The term "you" refers to you. 1. This Agreement does not grant you any right, title, or interest in any intellectual property rights associated with mathStatica, nor any right to copy, lease, sell, loan, or sublicense mathStatica. You agree not to (nor try to) decompile mathStatica to a source code version. 2. You agree that lending, renting, decompiling, sublicensing, or allowing unauthorized copying, alteration, or use of mathStatica shall constitute infringement of our proprietary rights, including copyright. 3. We make no warranties to you or any third party other than those specifically indicated in this Agreement. By accepting this Agreement, you warrant that you have read and understand all disclaimers of warranty and limitations of liability contained herein. 4. We make no representations, express or implied, with respect to mathStatica, including, without limitation, any implied warranty of non-infringement, interoperability, merchantability, or fitness for a particular purpose, all of which are expressly disclaimed. 5. In particular, we do not warrant that the software is free from all bugs; the product is sold as is. We do not warrant that the functions contained in mathStatica will meet your requirements or that the operation of the program will be free of error or uninterrupted. 6. In addition, you should recognise that all complex software systems contain errors and omissions. We shall not be responsible under any circumstances for providing information on or corrections to errors and omissions discovered at any time in the product, whether or not we are aware of the errors or omissions. We do not recommend the use of the software for applications in which errors or omissions could threaten life, injury or significant loss. 7. You understand that mathStatica depends on a third-party software product, namely Mathematica, manufactured by Wolfram Research of Champaign, Illinois; that purchase of mathStatica does not include any rights whatsoever to Mathematica; moreover, that we cannot and do not provide any guarantee that mathStatica will work correctly (or at all) with revised or future versions of Mathematica, nor that mathStatica will be compatible with the operating system you choose to use. 8. In no event shall we be liable to you or to any third party for any indirect, incidental, or consequential damages. This includes, but is not limited to, any damages resulting from loss of use, loss of profits, loss of data, or loss of business arising out of or in connection with this agreement. 9. In no event will our total liability to you for any and all claims arising out of this agreement exceed the total amount which was actually paid to us by you under this agreement as of the date such claim arose. 10. The terms and conditions of this Agreement are personal to you. You may not assign your rights. 11. This Agreement will be governed by (and interpreted in accordance with) the laws of the State of New South Wales, Australia. Any dispute relating to or arising under this Agreement must be filed in a court of competent jurisdiction located in New South Wales, and each party hereby submits to the jurisdiction of those courts.
